Passport and Visas : It is the responsibility of the individual traveller to check passport, visa and health requirements. All travellers departing India require a passport and it is recommended to have a minimum validity of 6 months. An Indian re-entry visa is required for those travellers travelling on a foreign passport. We are happy to provide assistance. You acknowledge sole responsibility for ensuring that the travelers adhere to visa expiration dates. Any extension of stay beyond the visa validity period is your sole responsibility to inform RIYA GROUP ENTERPRISE for the changes well in advance with the supporting documents or your passenger may change the date by themselves at the embassy with its own cost. In the event of any penalty/overstay liabilities for absconding or overstay of your visa applicants / traveler, you shall be solely responsible for the payment to RIYA GROUP ENTERPRISE for the said charges as per the invoice raised by RIYA GROUP ENTERPRISE / Embassy/ Consulate authorities.

USER'S OBLIGATIONS AND USER ACCOUNT
In consideration of use of the Website, the User represents and confirms that the User is of legal age to enter into a binding contract and is not a person barred from using the Website and/or receiving the Services under the laws of India or other applicable law.

The user also agrees and undertakes to immediately notify www.trvlnxt.com of any unauthorised use of the user's password or user id and to ensure that the user logs off at the end of each session at the website. www.trvlnxt.com shall not be responsible for any, direct or indirect, loss or damage arising out of the user's failure to comply with this requirement. The User also agrees to: (a) provide true, accurate and complete information about himself and his beneficiaries as prompted by the registration form ("Registration Data") on the Website; and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
If the User provide any information that is untrue, inaccurate, not current or incomplete or www.trvlnxt.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, www.trvlnxt.com has the right to suspend or terminate the User's registration and refuse any and all current or future use of the Website and/or any Service. Furthermore, the User grants www.trvlnxt.com the right to disclose to third parties, the Registration Data to the extent necessary for the purpose of carrying out the Services.
Breach : Without prejudice to the other remedies available to www.trvlnxt.com under this agreement, the TOS or under applicable law, www.trvlnxt.com may limit the user's activity, or end the user's listing, warn other users of the user's actions, immediately temporarily/indefinitely suspend or terminate the user's registration, and/or refuse to provide the user with access to the website if: (a) the user is in breach of this agreement, the TOS and/or the documents it incorporates by reference; (b) www.trvlnxt.com is unable to verify or authenticate any information provided by the user; or (c) www.trvlnxt.com believes that the user's actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or riya.travel. (d) www.trvlnxt.com may at any time in its sole discretion reinstate suspended users.
Once the user have been indefinitely suspended the user may not register or attempt to register with www.trvlnxt.com or use the website in any manner whatsoever until such time that the user is reinstated by riya.travel. Notwithstanding the foregoing, if the user breaches this agreement, the TOS or the documents it incorporates by reference, www.trvlnxt.com reserves the right to recover any amounts due and owing by the user to www.trvlnxt.com and / or the service provider and to take strict legal action as www.trvlnxt.com deems necessary.
Proprietary Rights : www.trvlnxt.com may provide the User with content such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks or other intellectual property rights and laws. The User may use this material only as expressly authorised by www.trvlnxt.com and shall not copy, transmit or create derivative works of such material without express authorisation from Riya Travel. The User acknowledges and agrees that they shall not upload, post, reproduce or distribute any content on or through the Website that is protected by copyright or other proprietary right of a third party, without obtaining the permission of the owner of such right. Any copyrighted or other proprietary content distributed on or through the Website with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorised submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.
Relationship : None of the provisions of this Agreement, terms and conditions, notices or the right to use the Website by the User contained herein or any other section or pages of the Website and/or the Linked Sites, shall be deemed to constitute a partnership between the User and www.trvlnxt.com and no party shall have any authority to bind or shall be deemed to be the agent of the other in any way. It may be noted, however, that if by using the Website, the User authorises www.trvlnxt.com and its agents to access third party sites designated by them or on their behalf for retrieving requested information, the User shall be deemed to have appointed www.trvlnxt.com and its agents as their agent for this purpose.
Any ADM arise due to the below mentioned reasons, the same has to be borne by the Travel Partner
ADM's will be borne by the agent if policy guidelines/instructions given below are either not implemented or adhered to.
1) Bookings :
In case, if traveler fails to fulfill airline terms & conditions, Riya Travels shall not be held liable for any discrepancies, penalties, refunds, ADMs (Agency Debit Memos), or cancellations by the airline.
2) Check in :
IF ANY AIRLINE / INSURANCE / HOTEL / BUS / SUPPLIER’S GIVEN OPERATION / SERVICE / REFUND ARE DELAYED / CANCELLED / WITHDRAWN, RIYA TRAVELS SHALL NOT BE LIABLE.
You may travel to certain destinations which involve greater risks than others, entirely at your risk as to cost and consequences.
You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. You acknowledge that some third–party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier’s rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in TrvlNxt debiting your account for any costs we incur as a result of such violation.
No waiver by Riya Group Enterprise of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by its duly authorized representative.
The User agrees to indemnify, defend and hold harmless www.trvlnxt.com from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by www.trvlnxt.com that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this Agreement and/or the TOS.
If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.
All notices and communications (including those related to changes in the TOS, Service, termination of Service etc.,) shall be in writing, in English and shall be deemed given if delivered personally or by commercial messenger or courier service, or mailed by registered or certified mail (return receipt requested) or sent via email/facsimile (with acknowledgment of complete transmission) to the following address: (a) If to Riya Travel, at the address posted on the Website. (b) If to a non-registered User, at the communication and/or email address specified in the application form availing of a www.trvlnxt.com Service. (c) If to a registered User, at the communication and/or email address specified in the registration form. Notice shall be deemed to have been served 48 hours after it has been sent, dispatched, displayed, as the case may be, unless, where notice has been sent by email, it comes to the knowledge of the sending party, that the email address is invalid
This agreement and each TOS are governed by and shall be construed in accordance with the laws of the Republic of India and any dispute shall exclusively be subject to the jurisdiction of the appropriate Courts situated at Mumbai, Maharashtra, India.
